How is legal ownership of property established?

The form of title establishes legal ownership of almost all property. Some forms of title will keep the property out of the jurisdiction of the court, as the property passes from one owner to another immediately at the moment of death. Examples of this type of ownership are: Joint Tenancy and Transfer On Death. These forms of property will supersede all other forms of ownership at death, including a Revocable Trust. For this reason, these forms of title should always be used cautiously, with full awareness of their power.
